Privacy statement

The Employment Desk helps employees with settlement agreements and dismissal. To do so, we need personal data from you. In this privacy statement, you can read which data that is, why we use it, who we share it with and how long we keep it. We handle your data with care and comply with the General Data Protection Regulation (GDPR).

The Employment Desk is the practice of Alain Heunen, employment law specialist. We are responsible for processing your personal data.

Which data do we process?

When you fill in the form on the website:

• your name, email address and phone number;
• your answers to the questions, such as whether you have received a settlement agreement, the reason for it, any contribution towards legal costs and what you want to achieve;
• the description of your situation, if you give one;
• your settlement agreement or other documents, if you upload them;
• the language you choose and the time of your request.

If you become a client:

• the data in your employment contract, payslips, correspondence with your employer and other documents you share with us;
• the data we need for our invoices.

Data about your health. In the form, you can indicate that the reason for the settlement agreement is long-term incapacity for work due to illness. Your documents may also contain information about your health. This is special category personal data. We only use it if you share it with us yourself, and only to assess your legal position and to advise and assist you. This is permitted under Article 9(2)(f) GDPR: the processing is necessary for the establishment, exercise or defence of legal claims.

What do we use your data for?

We do not use your data for marketing and we do not sell it.

Who do we share your data with?

We only share your data when necessary. We make agreements on security and confidentiality with the parties that process data on our behalf.

• Hosting and storage: the website and the storage of forms and uploads run on Lovable Cloud, with a Supabase database.
• Email: the confirmation email and the notification of your request are sent via Resend.
• AI: we use a business AI environment from Anthropic (see below).
• Your employer and their adviser: only if you instruct us to negotiate, and only the data needed for that.
• Authorities: if we are legally required to do so.

Third-party services on our website

• Calendly: if you schedule a call via the link on the website, this takes place on the Calendly website. Calendly then processes your name, email address and the time you choose. Calendly's privacy statement applies.
• WhatsApp: if you send us a message via WhatsApp, this goes through WhatsApp (Meta). WhatsApp's privacy statement applies.
• LinkedIn: the link to LinkedIn opens the LinkedIn website. LinkedIn's privacy statement applies.

Transfers outside the European Union

Some of the services we use are based in the United States or store data there, such as Lovable Cloud and Supabase (hosting and storage), Resend, Anthropic, Calendly and WhatsApp. Your data may then end up outside the European Union. We only choose services that offer appropriate safeguards, such as participation in the EU-US Data Privacy Framework or the European Commission's standard contractual clauses.

Use of AI

We use AI to work faster and more accurately, for example to calculate payslips or read long documents. For this, we use a business AI environment from Anthropic. The data we enter into it is not used to train AI models. Alain always does the advising, the assessment and the negotiating himself.

Cookies

Our website does not use tracking or advertising cookies, and no analytics services. We only use storage in your browser that is needed for the website to work properly. If we start using cookies that require consent in the future, we will ask for your consent first and update this privacy statement.

How long do we keep your data?

We do not keep your data longer than necessary for the purpose for which we received it.

• Requests that do not lead to an engagement: we delete your data and uploads as soon as they are no longer needed to handle your request.
• Client files: we keep your file for as long as necessary to complete the engagement and to be able to account for the advice given.
• Invoices and records: 7 years, as required by law.

How do we protect your data?

We take appropriate measures to protect your data. Uploads are kept in protected storage that is not publicly accessible. Only we have access to your data. Connections to the website are encrypted (https).

Your rights

You have the right to:

• access your data;
• have incorrect data corrected;
• have your data deleted, unless we are legally required to keep it;
• have the processing restricted;
• object to the processing;
• receive your data in a commonly used file format.
