The settlement check
Your employer has presented you with a settlement agreement (vaststellingsovereenkomst, VSO). Before you sign, you want to know whether it is right and what it gives you. That is the settlement check.
What we check
- Is there a fully substantiated ground for dismissal (voldragen ontslaggrond), and how much room do you have to negotiate?
- Is the severance payment correct, and have all salary components been included?
- Is your unemployment benefit (WW) safe, and does the end date match your notice period?
- What happens to your bonus, RSUs or stock options?
- Non-compete clause, holiday entitlement, garden leave (vrijstelling van werk), reference letter and full and final discharge (finale kwijting).
- Are you ill? Then we look extra carefully at the timing.
What you receive
Clear advice on what the settlement agreement means, what it is worth and whether anything is wrong. And answers to your questions. Afterwards you know whether signing is wise, or whether negotiating pays off.
What you upload
Your settlement agreement. Useful, but not required: your employment contract, recent payslips, earlier correspondence and, if relevant, your bonus or share plan. Do not have them to hand yet? Then we will ask for them later.
Price
EUR 875
excluding VAT
In 85% of cases, the employer reimburses the full legal costs. In almost all other cases, the employer pays at least a (substantial) part.
Does negotiating turn out to be worthwhile? Then you can move on to Package 1 or Package 2.
